Returns Policy and Right of Withdrawal

Right of withdrawal

 

These provisions apply if the user is a consumer, i.e. a natural person who purchases on the Site for purposes unrelated to their commercial, entrepreneurial or professional activity, and is resident in a Member State of the European Union.

1. User's Right of Withdrawal

 

The user has the right to withdraw from the purchase contract concluded on the Site, without providing any reason, within 14 days.

The withdrawal period expires after 14 days from the day on which the user, or a third party designated by them other than the carrier, acquires physical possession of the products. If the user has ordered multiple products with a single order and these are delivered separately, the period starts from the day on which they acquire physical possession of the last product.

The right of withdrawal is granted to the user for all products, including those on sale or promotion, and its exercise is not subject to any authorization from the Seller.

2. How to exercise the right of withdrawal

 

To exercise the right of withdrawal, before the deadline, the user must notify the Seller of their decision through an explicit statement. They can do so, at their choice: (i) by using the online withdrawal function ("withdrawal button") available on the Site in the dedicated "Right of Withdrawal" section accessible from the footer; (ii) by sending any other explicit statement to customercare@bogliolimilano.com or to Boglioli S.p.A., Via Brescia n. 47, Gambara (BS).

The user can use the standard withdrawal form referred to in Annex I, Part B, of the Consumer Code, but is not obliged to do so.

If the user uses the withdrawal button, located as indicated above, after entering the order identification data and their contact details, they can confirm the withdrawal by pressing the appropriate confirmation command. The user will receive, without undue delay, on a durable medium (e.g. via email), confirmation of receipt of their withdrawal statement.

 

To comply with the deadline, it is sufficient for the user to send the communication relating to the exercise of the right of withdrawal before the expiry of 14 days.

 

3. Effects of withdrawal and refunds

 

In case of withdrawal, the Seller will reimburse the user all payments made by them, including delivery costs (with the exception of additional costs resulting from any choice by the user of a type of delivery other than the least expensive type offered by the Seller), without undue delay and in any case within 14 days from the day on which the Seller was informed of the user's decision to withdraw.

The Seller will issue the refund using the same payment method used by the user for the purchase, unless the user has expressly agreed otherwise; in any case, the user will not incur any cost as a result of the refund.

The Seller may withhold the refund until it has received the products, or until the user has demonstrated that they have returned them, whichever occurs first.

 

4. Return of products

 

The user must return the products without undue delay and in any case within 14 days from the day on which they communicated their withdrawal to the Seller. The deadline is met if the user sends back the products before the 14-day period expires.

The direct costs of returning the products are regulated as follows. It is specified that, should the user use the courier appointed by the Seller, the transport costs for returning the products will be borne exclusively by the Seller. Should the user not use the courier appointed by the Seller (remaining free to contact other couriers), the costs relating to the return of the products will be borne by the user.

The user is solely responsible for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the products, as they would be allowed in a physical store. The right of withdrawal is therefore not excluded simply because the product has been removed from its packaging or deprived of its tag or seal, subject to the exclusions indicated in point 5.

If the returned products show a decrease in value resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning, the Seller may withhold from the refund an amount corresponding to such decrease in value. Customers are therefore advised to handle the products with care and, where possible, to return them with the labels still attached.

5. Exclusions

 

Only the cases provided for in Article 59 of the Consumer Code are excluded from the right of withdrawal, including, by way of example, the supply of custom-made or clearly personalized products and the supply of sealed products which are not suitable for return for hygienic or health protection reasons and which have been unsealed after delivery.

6. Order cancellation before shipment

 

Before the products are shipped, the user may request the cancellation or modification of the order by contacting Customer Service, without the need to activate the withdrawal procedure. In any case, the user's right of withdrawal within the terms indicated above remains unaffected.

 

7. Applicable law

 

These Terms of Use are governed by Italian law. With regard to the consumer, the choice of Italian law does not deprive them of the protection afforded by the mandatory provisions of the law of the European Union Member State in which they have their habitual residence (Article 6 Reg. EU 593/2008 - Rome I). For disputes with consumers, the court of the place of residence or elective domicile of the consumer, if located in the territory of the State, has exclusive jurisdiction.
